This article presents original empirical data generated from the Crown Prosecution Service (CPS) Pilot Evaluation of pre-trial witness interviewing (PTWI) in England and Wales. Section 1 introduces the PTWI Pilot and describes the methodological strengths and limitations of our qualitative socio-legal study. Forming the richly documented empirical core of the article, Sections 2–5 identify the principal considerations which seemed to influence case selection for Pilot interviews. An overlapping collection of evidentiary, strategic and circumstantial factors encouraged prosecutors to resort to PTWI, (...) whilst other, countervailing considerations were apprehended as disincentives. Assessments of witness credibility were central to prosecutors’ attempts to balance these competing factors. Section 6 concludes by underlining the potential of qualitative socio-legal studies to promote more nuanced understandings of criminal process, and by extension to make practical contributions to evidence-based criminal procedure reform. As a 2006 Institute of Medicine report highlights, surprisingly little empirical attention has been paid to how prisoners arrive at decisions to participate in modern research. With our study, we aimed to fill this gap by identifying a more comprehensive range of factors as reported by prisoners themselves during semistructured interviews. Our participants described a diverse range of motives, both favoring and opposing their eventual decision to join. Many are well-recognized considerations among nonincarcerated clinical research participants, including a desire for (...) various forms of personal benefit, altruism, and concern about study risks and inconveniences. However, a number of influences seem unique to prisoners. Participants did not report that they were not coerced into enrolling, and they have even been under pressure not to enroll. However, many sought to enroll in order to obtain access to better health care, raising a concern about whether they were unfairly exploited. (shrink)

Background: Therapeutic misconception, the misunderstanding of differences between research and clinical care, is widely prevalent among non-incarcerated trial participants. However, little attention has been paid to its presence among individuals who participate in research while incarcerated. Methods: This study examined the extent to which 72 incarcerated individuals may experience therapeutic misconception about their participation in one of six clinical trials, and its correlation with participant characteristics and potential influences on research participation. Results: On average, participants endorsed 70% of items suggestive (...) of therapeutic misconception. The tendency toward therapeutic misconception was significantly higher among African Americans and Latinos compared to Whites, among older and less educated participants, and among enrollment in a substance-abuse-related trial; it was also correlated with a belief that the trial was the only way to obtain needed treatment. Conclusions: Therapeutic misconception may be particularly high among select incarcerated individuals and is associated with a perceived lack of treatment options. Further examination of therapeutic misconception among incarcerated research participants is needed. (shrink)

Archaea are microorganisms that are distinct from bacteria and eukaryotes. They are prevalent in extreme environments, and yet found in most ecosystems. They are a natural component of the microbiota of most, if not all, humans and other animals. Despite their ubiquity and close association with humans, animals and plants, no pathogenic archaea have been identified. Because no archaeal pathogens have yet been identified, there is a general assumption that archaeal pathogens do not exist. This review examines whether this is (...) a good assumption by investigating the potential for archaea to be or become pathogens. This is achieved by addressing: the diversity of archaea versus known pathogens, opportunities for archaea to demonstrate pathogenicity and be detected as pathogens, reports linking archaea with disease, and immune responses to archaea. In addition, molecular and genomic data are examined for the presence of systems utilised in pathogenesis. The view of this report is that, although archaea can presently be described as non‐pathogenic, they have the potential to be (discovered as) pathogens. The present optimistic view that there are no archaeal pathogens is tainted by a severe lack of relevant knowledge, which may have important consequences in the future. Computer science only became established as a field in the 1950s, growing out of theoretical and practical research begun in the previous two decades. The field has exhibited immense creativity, ranging from innovative hardware such as the early mainframes to software breakthroughs such as programming languages and the Internet. Martin Gardner worried that "it would be a sad day if human beings, adjusting to the Computer Revolution, became so intellectually lazy that they lost their power of creative thinking" (Gardner, 1978, (...) p. vi-viii). On the contrary, computers and the theory of computation have provided great opportunities for creative work. This chapter examines several key aspects of creativity in computer science, beginning with the question of how problems arise in computer science. We then discuss the use of analogies in solving key problems in the history of computer science. Our discussion in these sections is based on historical examples, but the following sections discuss the nature of creativity using information from a contemporary source, a set of interviews with practicing computer scientists collected by the Association of Computing Machinery’s on-line student magazine, Crossroads. We then provide a general comparison of creativity in computer science and in the natural sciences. (shrink)

Simon Saunders and David Wallace attempt to use a modified form of David Lewis's analysis of personal fission to ground the claim that prior to undergoing Everett branching an informed subject can be uncertain about which outcome s/he will observe. I argue that a central assumption of this seductive idea is questionable despite appearing innocuous and that at the very least further argument is needed in support of it. Saunders & van Brakel's claim that Berlin and Kay (1969) assumed a language/vision correlation in the area of color categorization and disguised this assumption as a finding is shown to be false. The methodology of the World Color Survey, now nearing completion, is discussed and the possibility of an additional language/vision correlation in color categorization is suggested.

I continue to maintain that David Lewis’s concept of overlapping persons cannot yield pre-measurement uncertainty in the Everett interpretation of quantum mechanics in the way that Simon Saunders and David Wallace originally seemed to suggest. However, I argue that in their reply to me they make it clear that they do not wish to invoke overlap of persons after all. That makes it mysterious why they defended their interpretation of personal overlap in the first place and questionable what role (...) overlap has to play in their proposal. If Everettian branching can be understood to involve the divergence of distinct, non-overlapping worlds a concept of pre-measurement uncertainty is available. That idea was first proposed by David Deutsch but required an ad hoc postulate. Saunders has recently suggested that a similar scheme arises naturally out of the physics. If correct, that is important as it offers escape from some bizarre consequences of current alternative ways of understanding probability in the Everett interpretation. (shrink)

In the 1930s, C. I. Lewis, who was responsible for the revival of modal logic in the era of modern symbolic logic, characterized ‘intensional’ approaches to logic as typical of post-Leibnizian ‘continental philosophy’, in contrast to the ‘extensionalist’ approaches dominant in the British tradition. Indeed Lewis’s own work in this area had been inspired by the logic of his teacher, the American ‘Absolute Idealist’, Josiah Royce. Hegel’s ‘Subjective Logic’ in Book III of hisScience of Logic, can, I suggest, be (...) considered as an intensional modal logic, and this paper explores parallels between it and a later variety of modal logic—tenselogic, as developed by Arthur Prior in the 1950s and 60s. Like Lewis, Prior too had been influenced in this area by a teacher with strong Hegelian leanings—John N. Findlay. Treated as anintensional logic, Hegel’s subjective logic can be used as a framework for addressing issues ofintentionality—the mind’s capacity to be intentionally directed to objects. In this way, I suggest that the structures of his subjective logic can clarify what is at issue in the ‘Psychology’ section of theEncyclopaediaPhilosophy of Subjective Spirit. (shrink)

Gotama's way is genuine spiritual wisdom, and constantly compared with Christian mysticism as a way of enlightenment. It is therefore understandable that a Spaniard, who learned his catechism in (...) Ávila, and who was educated in the New England of Emerson and other Transcendentalists who honored Oriental wisdom, should have so much to say about the Buddha and Buddhism.The effort of this paper is to gather many of the isolated passages to give a coherent picture of Santayana and Buddhism. One difficulty to be overcome is that the philosopher rarely quotes his sources (the exception is a single quotation from Dasgupta). Although Santayana has numerous opinions, he does not reveal on which translations he has relied. Nor does he contrast different traditions of Buddhists. To overcome the vagueness of scholarship, I have used the volumes found in Widener Library: the sorts of books known to Santayana's dissertation director, Josiah Royce, and those of a sympathetic sort that had led Santayana as early as the writing of his dissertation on Rudolf Hermann Lotze to reject the latter's defiantly Christian and Western contempt for oriental "superstition." The sympathy can be expressed as similar to that of Schopenhauer in reading the Upanishads or Wilhelm von Humboldt in studying the Bhagavadgita. Santayana's study makes him aware of his Catholicism but he is unlike the Jesuit Dahlmann who attacks Buddhism as Nihilism. Santayana is more like his contemporaries who worked in psychology and philosophy of religion. Although Friedrich Heiler's work 1 and writings of James Bissett Pratt 2 were a bit too late to have influenced Santayana, comparison serves to illuminate and strengthen Santayana's conclusions. Perhaps Heiler is even more appropriate because Buddhistic insights remind him of those of St. Theresa. Santayana would support Pratt's view that Nirvana is not the annihilation of all desire but the extinguishing of evil passions. What Santayana finds congenial in Christian Neo-Platonism and in Spinoza, as well as in Buddhism, is the achievement of freedom of the spirit. 3 It has become a commonplace of world history that the two greatest founders of religion whose ways of salvation triumphed in Europe and in Asia respectively are the Christ and the Buddha. Philosophers of religion like Heiler accept both as saviors with a universal message, one, Jesus "the master of prayer" ("der Meister des Gebets"), the [End Page 151] other, Gotama "the master of contemplation" ("der Meister der Versenking"). Santayana is not concerned with the fact of the success of their missions, for there are indeed other triumphs such as Mohammed's Islam, and if it be classified as a religion, Marx's Communism. William James might well have patted Santayana on the back for struggling with the alternatives, for wrestling with a live option. In the current debate on the concept of probability in the Everett interpretation of quantum mechanics Saunders and Wallace argue for a notion of pre-measurement uncertainty whilst Greaves and Myrvold attempt to do without uncertainty altogether. Both these approaches are controversial and I suggest a middle way. I develop in detail an argument which Wallace has hinted at and Greaves has seen as beside the point in order to show that Vaidman’s concept of post-measurement uncertainty has more relevance to (...) pre-measurement decision making than has hitherto been generally recognised. Further, Vaidman uncertainty leads naturally to another form of post-measurement uncertainty which clarifies the process of experimental confirmation of quantum mechanics in the Everett picture. I also stress the importance of Sider’s theory of transtemporal identity in making Everett’s multiverse intelligible. (shrink)

Abstract:The closing section of James's "Philosophical Conceptions and Practical Results" contains a surprisingly abrupt dismissal of Kant's philosophy. This paper suggests that James's real target is his host, George Holmes Howison, whose Philosophical Union had invited James to speak at Berkeley. James and Howison shared a common commitment to pluralism in opposition to the Absolute monism such as Josiah Royce was developing. Howison relies on Kant's account of the a priori as well as his moral ideal of a Kingdom (...) of Ends in order to fashion a pluralistic form of |idealism that would avoid the errors he found in Absolute monism while also countering the influential evolutionary philosophy of Herbert Spencer. While James shared Howison's opposition to monism, as well as his critical view of Spencer, he did not share his aversion to evolutionary ideas. Ultimately, the pragmatism that he announced at Berkeley would reply to Howison's Kantian approach by retaining a pluralism while building on the modern psychology growing out of evolution. James's position would test the alliance that they had forged against monism. In time, it would prove too fragile to withstand their growing differences until a final break came in the year before James's death. (shrink)

Although Santayana insisted that his book on Hermann Lotze was merely a journeyman's task imposed upon him by his master Josiah Royce, the evidence of the text is otherwise. Santayana is warmly engaged not only in refuting Royce's absolutism, he is also giving the first expression to his own aesthetic naturalism. Santayana uses Lotze's pluralistic system to rebuke his teacher's monism, particularly when the unity of the world is interpreted as the adventures of a single mind and everything that (...) happens is said to be for its satisfaction. Santayana might have wished to write on Schopenhauer, but in Lotze also he found an ally in the cause against the idolatry of power and human purpose which so oppressed him in the doctrines of divine providence and the secularized version of inevitable progress. I show that frequentism, as an explanation of probability in classical statistical mechanics, can be extended in a natural way to a decoherent quantum history space, the analogue of a classical phase space. The result is a form of finite frequentism, in which Gibbs’ concept of an infinite ensemble of gases is replaced by the quantum state expressed as a superposition of a finite number of decohering microstates. It is a form of finite and actual frequentism (as opposed to hypothetical (...) frequentism) insofar as all the microstates exist, in keeping with the decoherence-based Everett interpretation, and some versions of pilot-wave theory. In 2007, the artist Josiah McElheny stumbled across a reference to a little-known short story by Paul Scheerbart, “Der Lichtklub von Batavia: Eine Damen-Novellette” (“The Light Club of Batavia: A Ladies’ Novelette”) (1912). McElheny, recognized for his work with glassblowing and elaborate sculptural installations consisting of glass and mirrored objects, was already familiar with Scheerbart’s utopian treatise on glass architecture, which called for the creation of a spiritual environment built from new technology, “the new environment [that] . . In this review of the Korean cloning scandal involving Woo-Suk Hwang, the nature of the disaster is documented and reasons why it occurred are suggested. The general problems it raises for scientific research are highlighted and six possible ways of improving practice are offered in the light of this case: better education of science students; independent monitoring and validation; guidelines for tissue donation for research; fostering of debate about ethically contentious research in science journals; development of an international code of (...) ethical research practice; fostering of public involvement in ethical review and debate through the web. The paper defends a view of structural realism similar to that of French and Ladyman, although it differs from theirs in an important respect: I do not take indistinguishabiity of particles in quantum mechanics to have the significance they think it has. It also differs from Cao's view of structural realism, criticized in my "Critical Notice: Cao's `The Conceptual Development of 20th Century Field Theories".

Noam Chomsky and Frances Egan argue that David Marr’s computational theory of vision is not intentional, claiming that the formal scientific theory does not include description of visual content. They also argue that the theory is internalist in the sense of not describing things physically external to the perceiver. They argue that these claims hold for computational theories of vision in general. Beyond theories of vision, they argue that representational content does not figure as a topic within formal computational theories (...) in cognitive science. I demonstrate that Chomsky’s and Egan’s claims about Marr’s theory are false. Marr’s computational theory contains a mathematical theory of visual content, based on empirical psychophysical evidence. It also contains mathematical descriptions of distal physical surfaces and objects, and of their optic projection to the perceiver. Much computational research on vision contains these types of intentional and externalist components within the formal, mathematical, theories. Chomsky’s and Egan’s claims demonstrate inadequate study and understanding of Marr’s work and other research in this area. Computational theories of vision, by containing empirically based mathematical theories of visual content, to this extent present naturalizations of semantics. (shrink)

Category Theory has developed rapidly. This book aims to present those ideas and methods which can now be effectively used by Mathe­ maticians working in a variety of other fields of Mathematical research. This occurs at several levels. On the first level, categories provide a convenient conceptual language, based on the notions of category, functor, natural transformation, contravariance, and functor category. These notions are presented, with appropriate examples, in Chapters I and II. Next comes the fundamental idea of an adjoint (...) pair of functors. This appears in many substantially equivalent forms: That of universal construction, that of direct and inverse limit, and that of pairs offunctors with a natural isomorphism between corresponding sets of arrows. All these forms, with their interrelations, are examined in Chapters III to V. The slogan is "Adjoint functors arise everywhere". Alternatively, the fundamental notion of category theory is that of a monoid -a set with a binary operation of multiplication which is associative and which has a unit; a category itself can be regarded as a sort of general­ ized monoid. Chapters VI and VII explore this notion and its generaliza­ tions. Its close connection to pairs of adjoint functors illuminates the ideas of universal algebra and culminates in Beck's theorem characterizing categories of algebras; on the other hand, categories with a monoidal structure lead inter alia to the study of more convenient categories of topological spaces. Abstractabstract:John Stuart Mill's harm principle holds that an individual's freedom can only be restricted to prevent harm to others. However, there is an important ambiguity between a strong version, which limits legitimate interference to self-defense and therefore prohibits society from protecting third parties (those who are not its members), and a narrow version, which grants any society universal jurisdiction to prevent nonconsensual harms, no matter who is harmed. Mill sometimes appeals to the strong harm principle to preclude interference, but elsewhere (...) endorses measures (including humanitarian foreign intervention and animal cruelty laws) to protect third parties, suggesting that he subscribes only to the weak harm principle. This ambiguity regarding who it is that society has standing to protect has important implications for the scope of individual freedom. (shrink)

In "Philosophy's role in theorizing psychopathology," Gibson presents a defense of the continued relevance of philosophy to psychopathology, and a non-exhaustive framework for the role of philosophy in this domain (Gibson, 2024). I find it hard to disagree that psychopathology is soaked in philosophy from its origins, and that to try and dry it out would be both unwise and impossible.In this commentary, I go back to Karl Jaspers' account of the role of philosophy in his General Psychopathology.
